Railroad Litigation

Railroad litigation is a unique area of law involving the liability of railroad companies, state highway departments, adjacent landowners, or other parties who may be responsible for the safety of railroad tracks, property, crossings and trains. Attorneys practicing in this area must be familiar with corporate and industry practices, terminology, experts, regulatory issues, land use issues and remain current on court decisions and legislative events affecting the railroad industry. For years, our attorneys have aggressively and tactfully represented clients against railroad companies in pedestrian, derailment, and collision cases. Also, highway defects often play a role in these cases and must be considered as well.

Russ Herman was the chairman of ATLA's Railroad/Highway Crossing and Derailment Litigation Group, a group in which the firm is still integrally involved. The group is a voluntary, non-profit group, comprised of ATLA members handling railroad personal injury cases or having an interest in such cases. The group provides a collegial networking structure whereby members exchange documents, deposition testimony, and other information; share experiences; and develop discovery and litigation strategies in the spirit of professional cooperation toward mutually-held goals.
